1. Definitions
Throughout these terms, the following definitions apply:
- “Platform” means the MyCoach website and related services.
- “Coach” means any independent professional who creates a profile to market coaching services.
- “Client” means any individual or organisation researching or engaging a Coach through the Platform.
- “You” or “user” means any person accessing or using the Platform.
2. Acceptance of agreement
By accessing or using the Platform, you agree to these Terms and any policies referenced within them. If you use the Platform on behalf of an organisation, you confirm that you have authority to bind that organisation and that it accepts these Terms.
3. Account registration and security
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- Notify us immediately if you believe your account has been compromised.
4. Coach responsibilities
Coaches agree to:
- Maintain truthful, non-misleading profile content and pricing information.
- Comply with applicable licensing, professional, and ethical obligations.
- Handle enquiries, bookings, payments, and service delivery independently of the Platform.
- Keep client information confidential and use it solely for legitimate service purposes.
5. Client responsibilities
- Use the Platform to evaluate coaches in good faith and communicate respectfully.
- Conduct your own due diligence before engaging a Coach and agree commercial terms directly with them.
- Refrain from sharing content that is unlawful, defamatory, discriminatory, or infringing.
6. Platform scope and limitations
MyCoach is a discovery and marketing platform. We do not employ Coaches, guarantee outcomes, or process payments between users. Any agreements for coaching services are formed solely between Coach and Client.
7. Acceptable use
- No reverse engineering, scraping, or automated harvesting of the Platform.
- No attempts to gain unauthorised access or disrupt the Platform’s operation.
- No uploading of malicious code or content that infringes third-party rights.
8. Intellectual property
The Platform and its content are owned by MyCoach or our licensors. We grant you a limited, revocable, non-exclusive licence to access and use the Platform for its intended purpose. You retain ownership of content you submit, but grant us a licence to display and distribute that content within the Platform.
9. Reviews and feedback
Clients may submit reviews describing their experience with Coaches. Reviews must be honest, relevant, and comply with our acceptable use standards. MyCoach may moderate or remove reviews that breach this policy.
10. Termination
We may suspend or terminate access to the Platform if you violate these Terms or where we are required to do so by law. You may close your account at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, and liability) will remain in effect.
11. Disclaimers
The Platform is provided on an “as is” basis. We do not guarantee the accuracy of listings, the availability of Coaches, or the outcomes of any coaching engagement. To the maximum extent permitted by law we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, MyCoach will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our aggregate liability for any claim related to the Platform will not exceed the greater of (a) the amount paid by you to MyCoach in the 12 months preceding the claim or (b) USD 100.
13. Indemnification
You agree to indemnify and hold harmless MyCoach, its affiliates, and personnel from any claims, liabilities, damages, and expenses arising from your use of the Platform or breach of these Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of the jurisdiction in which MyCoach is incorporated, without reference to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
15. Changes to these terms
We may update these Terms to reflect product changes, legal requirements, or operational needs. When we make material updates we will provide reasonable notice, and your continued use after the effective date constitutes acceptance of the revised Terms.
